1. Acceptance of terms
These Terms of Service ("Terms") form a legally binding agreement between you and Membership Management ("we", "us" or "our"). They govern your access to and use of our website, online banking platform, mobile applications and any related products or services (together, the "Services"). If you do not agree with any part of these Terms, you must not use the Services.
2. Eligibility & accounts
To open an account you must be at least 18 years of age (or the age of majority in your jurisdiction), provide accurate and complete registration information and successfully complete our identity verification process. You agree to keep your personal details up to date and to notify us promptly of any change to your name, address, email or phone number.
Each customer may hold only one personal profile. Business accounts must be opened by an authorised representative of the business who has the legal authority to bind it to these Terms.
3. Your security responsibilities
You are responsible for maintaining the confidentiality of your sign-in credentials, including your password, PIN and any one-time verification codes. You must:
- never share your credentials with anyone, including people claiming to be Membership Management staff;
- sign out after each session on shared or public devices;
- notify us immediately if you suspect your account has been accessed without authorisation; and
- keep the devices you use for banking protected with up-to-date software and security settings.
Provided you have met these responsibilities, you will not be held liable for unauthorised transactions carried out through our digital banking channels.
4. Digital banking services
Through the Services you may view balances and transactions, transfer funds, pay bills, deposit cheques, apply for products and communicate with us. Some features may be subject to limits, additional verification or eligibility criteria. We aim to make the Services available at all times but do not guarantee uninterrupted access, and we may suspend features for maintenance, security or regulatory reasons.
Transfer instructions received after our daily cut-off time, or on weekends and holidays, will be processed on the next business day. You are responsible for ensuring that payment details you enter are correct; we may be unable to recover funds sent to an incorrect recipient.
5. Fees, rates & disclosures
Fees and interest rates applicable to your accounts, cards and loans are set out in the relevant product agreement and fee schedule provided when you open the product. Rates displayed on our website are for illustration and may change without notice. Where we change a fee or rate we will notify you in advance as required by law.
6. Prohibited use
You agree not to use the Services for any unlawful purpose, including money laundering, fraud, financing of terrorism or any activity that breaches sanctions laws. You must not attempt to gain unauthorised access to our systems, interfere with their operation, reverse engineer our applications or use automated tools to access the Services without our written consent.
7. Limitation of liability
To the fullest extent permitted by law, Membership Management will not be liable for any indirect, incidental, special or consequential loss arising from your use of, or inability to use, the Services, including loss caused by events beyond our reasonable control such as network failures, natural disasters or actions of third parties. Nothing in these Terms limits any rights you have under applicable consumer protection or banking legislation.
8. Termination
You may close your account at any time by contacting us, subject to settling any outstanding balance. We may suspend or terminate your access to the Services if you breach these Terms, if required by law or regulation, or where we reasonably suspect fraudulent or unlawful activity. Sections that by their nature should survive termination will continue to apply.
9. Changes to these terms
We may update these Terms from time to time. The most current version will always be available on this page, and we will notify you of material changes by email or through the Services. Continued use of the Services after a change takes effect constitutes your acceptance of the revised Terms.
10. Contact
Questions about these Terms can be sent to us through our contact page or by email at contact@montrealharris.ca. Please also review our Privacy Policy, which explains how we collect and use your information.
